GENERAL RULES AND CONDITIONS

Current parking systems:

Santiago automatic parking (WITHOUT LEAVING THE KEYS)

ARTICLE 1 OBJECT

This Regulation establishes the rules for the use of the outdoor and covered parking for light vehicles, owned by the company Parking Santiago S.L., in Lugar do Noval, hereinafter referred to as the Car Park.

ARTICLE 2 SCOPE OF APPLICATION

This Regulation applies to all Users of the Car Park, regardless of the regime of use of the Car Park services.

ARTICLE 3 PARKING

  1. The Car Park has: 300 (three hundred) parking spaces.
  2. In duly justified cases, the right to decrease or increase the number of spaces is reserved.
  3. Information on the status of the Car Park (free/full), on the current hourly rates and opening hours will be provided at the entrance to the Car Park.
  4. This Regulation will be published in the Car Park and, failing that, on the website www.parkingsantiago.es.
  5. A complaints book regarding the operation of the Car Park and the performance of the security personnel will be made available to Users.

ARTICLE 4 SPECIFIC PARTS AND COMMON PARTS

  1. The Car Park consists of specific parts and common parts.
  2. The specific parts are the spaces intended for the parking of light vehicles.
  3. The common parts of the Car Park are as follows:
    1. Entrances, circulation spaces for vehicles and pedestrians;
    2. Water, sewerage and electricity networks;
    3. Sanitary facilities;
    4. Spaces and equipment for the technical services and services of the personnel assigned to the Car Park.

ARTICLE 5 RULES OF USE OF THE CAR PARK

  1. The regimes of use of the Car Park are the following:
    1. Rotation with payment per fraction of time;
    2. Monthly fee for total use;
      1. In the Rotation Regime with payment per fraction of time, the user has the right to park a light motor vehicle, in any vacant space within the set of spaces available for this regime for a period of time and within the defined time, upon payment of a fee, depending on the period used and the contracted modality.
      2. The user of a Monthly Use Fee (subscription) has the right to park a light motor vehicle, in any available place in the Car Park (with the exception of those with marked places) at any time and day, for any period of time, within the period of validity of the fee, upon payment of the established fee.

ARTICLE 6 SCOPE OF APPLICATION

This Regulation applies to all Users of the Car Park, regardless of the regime of use of the Car Park services.

ARTICLE 7 OPENING HOURS

  1. The Car Park has the following opening hours: Rotation and Subscriber Total Use Regime – 24 hours a day;
  2. Regardless of the hours defined above, the Car Park may close for reasons of force majeure, in particular in the event of:
    1. Occurrence of natural disasters;
    2. Anomalous situations that imply danger to Users or vehicles;
    3. Need to carry out repairs inside the Car Park, which, for this purpose, must be, totally or partially, free and unoccupied.
    4. The Car Park will have free transport for Car Park customers to the airport and vice versa from 04:30 to 00:30.

ARTICLE 8 ACCESS CARDS

  1. Users are responsible for the custody and conservation of the cards;
  2. In case of loss, theft or deterioration of the card, the user must request a duplicate of it, the cost of which will be increased according to the current price table.
  3. Failure to pay the due fee implies the automatic cancellation of the respective card.

ARTICLE 9 LOSS OR MISPLACEMENT OF THE ACCESS PERMIT

  1. The parking ticket, collected from the machine at the entrance to the Car Park and validated by payment at the automatic payment machine, is considered the only valid ticket for confirming the time and date of entry, time and date of exit and payment effect.
  2. In case of loss or misplacement of the parking ticket by occasional users, Parking Santiago, S.L. has the right to review the vehicle's entry and exit records and charge you the current rotation fee at that time (without discounts) or the lost ticket fee.
  3. If the occasional user's vehicle has remained inside the Car Park for more than 24 hours, Parking Santiago may charge 24-hour fees for each day of the vehicle's stay, including the day on which the occasional user wishes to pick it up and regardless of the time they do so.

ARTICLE 10 VEHICLE CLASSES

The Car Park is intended for the parking of light motor vehicles.
Maximum permitted height 2.20 meters.

ARTICLE 11 ACCESS PROCEDURES

  1. To access the Car Park, occasional users in rotation with payment per time/daily fraction must obtain the coded access ticket, online (QR code) through the website or next to the equipment made available at the entrance access, or, in case of non-operation of this equipment, from the Car Park guards.
  2. Subscription users must validate the access card in the control equipment located at the entrance to the Car Park.

ARTICLE 12 PAYMENT

  1. Payment of the amount due for the use of the Car Park will be made at the Car Park's ATM, which is in a duly marked place.
  2. Payment of Subscriptions must be made no later than the eighth day of the corresponding month.
  3. Failure to pay on the scheduled date by users under the Subscription regime implies the immediate suspension of the right to use the Car Park and the automatic cancellation of the access card.

ARTICLE 13 EXITING THE CAR PARK

  1. To leave the Car Park, occasional users must show the ticket or coded access reservation with a "QR" code (online reservations), after payment validation, at the exit control device located in the "vehicle exit" area, for which they have thirty minutes after payment.
  2. If the vehicle does not leave within this period of time, the amount corresponding to the minimum parking period started will be charged.
  3. Other Users must validate the access card in the exit control equipment located in the "vehicle exit" area.

ARTICLE 14 GENERAL PROCEDURES

  1. The search for a space and the parking of vehicles will be carried out by the Users, under their exclusive responsibility, taking into account the established areas and directions of circulation.
  2. Circulation within the Car Park is subject to the provisions of the Traffic Code and Complementary Legislation.
  3. People or animals are not allowed to remain inside the vehicles after they have been parked.
  4. When the parking spaces are all occupied, the Car Park will be closed, with a ban on the entry of vehicles, and will reopen as soon as this circumstance ceases to occur.
  5. In case of maintenance work, overbooking or other reasons beyond the control of the car park, for a better use of the space it is necessary to leave the keys so that the staff of Parking Santiago, S.L. can park the vehicle.   6. The prohibition of entry to the Car Park will be announced with the use of the word "Full" on the panel outside the entrance to the Car Park.
  7. Washing, repairing or carrying out maintenance work on vehicles inside or at the accesses to the Car Park is not permitted, except in cases of force majeure and within the strict limits of what is necessary for the removal of the vehicle from inside the Car Park.
  8. The transfer of the Customer and a maximum of 2 companions from the Car Park to the Airport and vice versa will be free of charge. This will be arranged by the Company, according to what is specifically agreed between the Customer and the Company. More than 3 passengers will only be transferred if the rest of the passengers are minors, in which case the driver and all the minors will be transferred.

ARTICLE 15 ABUSIVE PARKING

  1. Excessive parking is understood to mean vehicles that:
    1. If they have been parked for more than two months without the owner paying the amount of the fees corresponding to that period;
      Park outside the spaces intended for this purpose;
    2. Remain in the Car Park for periods longer than forty-eight hours and show obvious external signs of abandonment or inability to move safely by their own means.
  2. In the case of abusive parking, Parking Santiago will promote the removal of the vehicle to a place in the Car Park that it considers convenient or to an existing external depot for this purpose, with the owner of the vehicle being responsible for all the expenses of said removal.
  3. The use of more than one space for one parking will be charged at the price of two spaces.

ARTICLE 16 OBLIGATIONS OF USERS

Users of the Car Park are obliged to scrupulously respect the provisions of this Regulation, as well as current legislation, in particular:

  1. Respect the rules of signage, hygiene and safety established inside and at the access to the Car Park
  2. Obey the legitimate instructions given by Parking Santiago, respecting all existing notices in the Car Park;
  3. Do not drive vehicles inside the Car Park under the influence of alcohol, psychotropic substances or narcotics;
  4. Do not practice acts contrary to the law or public order in the Car Park;
  5. Do not give the Car Park a use other than that for which it is intended;
  6. Do not carry out any washing, lubrication and car repair assistance operations inside the Car Park, except for emergency repairs to the extent strictly necessary to allow the removal of the vehicle;
  7. Respect the maximum circulation speed inside the Car Park, never exceeding the speed of 20 km/hour;
  8. Circulate and maneuver with the necessary prudence to avoid any and all accident situations;
  9. Do not park the vehicle in the circulation lanes or in any other place that does not constitute a parking space and, in any case, that prevents or hinders the circulation or maneuvers of other Users;
  10. Do not perform any act that in any way makes it impossible, difficult or creates obstacles for the use of the Car Park by other Users;
  11. Do not park the vehicle beyond the space reserved for a single vehicle, marked by the indelible lines marked on the pavement;
  12. Do not introduce explosive substances or combustible or flammable materials into the Car Park;
  13. Do not make a fire inside the Car Park;
  14. Do not make unauthorized use of the power outlets and electrical installations of the Car Park.

ARTICLE 17 RESPONSIBILITY OF USERS

  1. Parking and circulation in the Car Park are the responsibility of the Users and owners of the vehicles, under the conditions established in current legislation.
  2. In the event of accidents occurring in the Car Park that cause damage to the facilities, equipment, service personnel of the Car Park, vehicles or third parties, the responsibility for which is presumed to be attributable to a User, it is the duty of the User to assume compensation and compensation for all damages caused.
  3. The person responsible for the accidents, damages or other acts referred to in the previous paragraph is obliged to immediately inform the service personnel of the Car Park.
  4. If the communication provided for in the previous paragraph has not been made or if the person responsible refuses to comply with the provisions of section 2 of this article, the presence of the authorities will be requested, and the repeat offender User will be responsible not only for the damages caused but also for all the expenses incurred by Parking Santiago with the procedures it has to carry out.
  5. The user will be responsible, before the employer and the other users, for the damages they cause, due to breach of their duties or lack of skill in driving the vehicle within the garage or parking area (art. 5.2 Law 40/2002).

ARTICLE 18 EXCLUSIONS OF LIABILITY

  1. For the purposes of civil and criminal liability, the Car Park is an extension of the public highway, and the access control system is intended solely for the measurement, collection and billing of the time each vehicle remains inside.
  2. Parking is at the expense and risk of the vehicle owners.
  3. Parking Santiago SL is not responsible for damages caused by third parties, whatever their cause, to people or vehicles parked or circulating in the Car Park.
  4. Since the parking does not constitute a deposit contract, either of the vehicles or of the objects found in them, Parking Santiago is not responsible for any damage, theft or robbery, when it occurs inside the Car Park.
  5. No liability may be attributed to Parking Santiago that does not arise from the fault of the latter, of its personnel, whether for damages caused to persons, animals or objects, which are in the Car Park or on the access roads, and whatever the causes of said damages.
  6. Parking Santiago informs its Customers that the insurance policy does not cover any damage resulting from natural disasters or adverse weather conditions.
  7. We are not responsible for isolated glass breakages.
  8. We recommend that you use the courtesy transfer to the airport. Airlines recommend 2 hours in advance for international flights and 1 hour for domestic flights. Although it only takes a few minutes to enter your vehicle and transfer it to the terminal, you must arrive at our facilities 20 minutes before the opening time of your flight's check-in. We are not responsible for the loss of your flight.
  9. The company is not responsible for the loss of your flight if you do not comply with the check-in and if you have not given yourself enough time, or if the courtesy transport service is delayed, for example due to excessive traffic, weather conditions or delay in entering the access to the terminal because it is full, etc.
  10. The company will never be responsible for any problem your car has when starting, due to mechanical failures, problems with the windows, flat tires, damage to the bodywork or lack of battery. We only commit to helping as much as possible, and the customer cannot complain about these facts.

ARTICLE 19 RATES

The values of the fixed rates may be updated by indication of the Car Park Management.

ARTICLE 19.1 ONLINE PURCHASE PROCESS

For the acquisition of the Services offered on the Website, the Customer must follow the instructions shown on the screen and accept the purchase by complying with the said indications.

If the Customer is a natural person, they must be at least 18 years old to acquire the Services.

The contracting will be carried out by the Customer completing the different forms that are presented throughout the entire purchase process and the express acceptance by the Customer of these Terms and Conditions and of all the conditions applicable to the contracted product. In the purchase process, sending the form once completed, by pressing the "Pay and Finalize Purchase" button will finalize the process and will mean the full acceptance by the Customer of the commercial proposal of Parking Santiago and of the applicable conditions, redirecting to a purchase confirmation page on the screen, which the Customer can print.

In the case of contracting the parking service with online payment (pre-payment). 100% of the money paid will be refunded if canceled 48 hours before the performance of said service, 50% will be refunded if it is between 48 hours and 24 hours before the service. And nothing will be refunded if it is canceled with less than 24 hours of the performance of said service. This cancellation will only be valid when it is communicated by email to info@parkingsantiago.es accompanied by the corresponding reservation number. If the withdrawal is later than the agreed date, the Customer will settle the outstanding days of payment, paying the amount at the daily prices in force on the date of withdrawal of the Vehicle. In case of withdrawing the vehicle before the scheduled date, you are not entitled to any type of refund.

ARTICLE 20 SANCTIONS

Without prejudice to any civil or criminal liability that may apply, infringements of the provisions of this regulation will be sanctioned in accordance with the applicable legislation.

ARTICLE 21 OMISSIONS

All omissions will be subject to the rules provided for in the Traffic Code and other complementary legislation.

ARTICLE 22 ENTRY INTO FORCE

This Regulation enters into force on September 10, 2024.

Additional information:

This car park regulates its commercial activity in accordance with Law 40/2002, of November 14, which regulates the vehicle parking contract, and with the terms and conditions contained in these General Rules. The act of entering this establishment with a vehicle or on foot implies acceptance of these regulatory rules.

In cases of loss of the parking ticket in which the user is not in possession of the vehicle keys, ownership of the vehicle must be justified by means of a D.N.I. (National Identity Document) and vehicle documentation.

 

Parking Santiago KEY CUSTODY (LEAVING KEYS)

Article 1 - DEFINITION

For all purposes, the parties agree to the following definitions

  1. Company: Parking Santiago SL. with CIF B 70493580 and address Lugar Noval nº 51, Lavacolla , 15820 Santiago de Compostela (A Coruña)
  2. Parking Santiago: or just Parking, run by the Company (Parking Santiago S.L.), outdoor or covered and with strict admission to third parties, and facilities of other entities that have an agreement with Parking Santiago within a 6 km radius
  3. Customer: Individual or legal entity that will use the Parking under the conditions provided for in this agreement.
  4. Vehicle: Motor vehicle or motorcycle that the customer, for any legitimate reason, has at their disposal, not including any accessory good not incorporated into it, and that can be stolen.

Article 2 - OBJECT OF THE CONTRACT

The purpose of this contract is the provision of the facilities of the Parking Santiago parking and facilities of other entities that have an agreement with Parking Santiago within a 6 km radius, for the periods of duration agreed between the customer and the Company, observing the other conditions provided for in the following clauses

Article 3 - DURATION OF THE CONTRACT

This contract will have the duration agreed in each case between the Customer and the Company, without prejudice to the fact that this period can be extended or reduced, by means of communication between the parties

In the case of prior/pre-paid reservations, schedule changes will be free of charge.

This contract may be automatically canceled in the following cases:

  • Delivery of the vehicle later than the reserved time. If after more than 60 minutes from the reserved time, the customer does not deliver their vehicle, said reservation will be canceled.
  • Breach of contract by the customer.
  • If the parking staff deems it appropriate (disrespect, aggression or repeated breach of parking conditions, ...).

Article 4 - CONDITIONS

  1. Without prejudice to the other provisions of this Contract, upon subscription of the same, the following benefits will be ensured to the Customers:
    1. Guarding of the Vehicle in the Parking Santiago Parking, or in facilities of other entities that have an agreement with Parking Santiago within a 6 km radius for the duration of this Contract.
    2. Parking Santiago reserves the right to move the vehicle between the car parks and facilities of other entities that make their car parks and facilities available to it for a better optimization of the parking spaces it has.
    3. The collection of the customer's vehicle at the airport (Valet/Driver Car) to Parking Santiago and vice versa, as specifically agreed between the parties, will be carried out by duly identified and authorized collaborators of the company.
    4. The Transport will be free for the Customer and a maximum of 2 companions from the Parking Santiago Parking to the Airport and vice-versa. This will be arranged by the Company, as specifically agreed between the Customer and the Company. More than 3 passengers will only be transferred if the rest of the passengers are minors, in which case the driver and all the minors will be transferred.
    5. Other benefits that, being able to be provided by the Company, such as, vehicle washing, may be offered by the Company at any time and specifically agreed with the Customer.
  2. The attribution of the benefits conferred in the previous point presupposes that:
    1. The key of the Vehicle will be delivered by the Customer to authorized representatives of the Company, when the deposit of this is in the Parking Santiago Parking or its collection at the Airport (Valet/Driver Car), which will be parked in the facilities of Parking Santiago or in facilities of other entities that have an agreement with Parking Santiago, within a 6 km radius.
    2. The authorized employees of the Company may, at any time, proceed to move the Vehicle, within the enclosure of the Parking Santiago Parking in order to allow the movement of other vehicles of the Parking Santiago Parking that are meanwhile removed by other Customers, or in any case allow the optimization of the parking spaces of the Parking Santiago Parking.
    3. Parking Santiago reserves the right to move the vehicles between the car parks and facilities of other entities that make their parking lots available to the company, for a better optimization of the parking spaces it has.
    4. Authorizes the driving of the vehicle from the airport to Parking Santiago or facilities of other entities that have an agreement with Parking Santiago within a 6 km radius from the airport without the need for prior agreement.
  3. In the case that the Customers contract the service for periods longer than one month and with periodic payments, the payments will be made by means of direct debit receipts that the Company will issue between the 1st and 5th of each month. In the case of return of the receipt, the Company may charge the return expenses to the Customer.
  4. In the case of contracting the parking service for a fixed period, payment will be made in advance. In the event that the Customer decides to withdraw the Vehicle before the designated date, they may do so without the right to a refund of any amount, paying the total price agreed in this Contract. If the withdrawal is later than the agreed date, the Customer will settle the amount at the daily prices in force on the date of withdrawal of the Vehicle, unless expressly indicated in this Contract.
  5. In the case that the Customer contracts the Battery Charging Service, the Customer authorizes by this Contract for the Company to connect the cables to the battery terminals.
  6. In the case of contracting the parking service with online payment (prepayment). 100% of the money paid will be refunded if canceled 48 hours before the performance of said service, 50% will be refunded if it is between 48 hours and 24 hours before the service. And nothing will be refunded if it is canceled with less than 24 hours of the performance of said service. This cancellation will only be valid when communicated by email to info@parkingsantiago.es accompanied by the corresponding reservation number. If the withdrawal were later than the agreed date, the Customer will settle the pending days of payment, paying the amount at the daily prices in force on the date of withdrawal of the Vehicle.

ONLINE PURCHASE PROCESS

For the acquisition of the Services offered on the Website, the Customer must follow the instructions shown on the screen and accept the purchase by complying with the said indications.

If the Customer is a natural person, they must be at least 18 years old to acquire the Services.

The contracting will be carried out by the Customer completing the different forms that are presented throughout the entire purchase process and the express acceptance by the Customer of these Terms and Conditions and of all the conditions applicable to the contracted product. In the purchase process, sending the form once completed, by pressing the "Pay and Finalize Purchase" button will finalize the process and will mean the full acceptance by the Customer of the commercial proposal of Parking Santiago and of the applicable conditions, redirecting to a purchase confirmation page on the screen, which the Customer can print.

In the case of contracting the parking service with online payment (pre-payment). 100% of the money paid will be refunded if canceled 48 hours before the performance of said service, 50% will be refunded if it is between 48 hours and 24 hours before the service. And nothing will be refunded if it is canceled with less than 24 hours of the performance of said service. This cancellation will only be valid when it is communicated by mail to info@parkingsantiago.es accompanied by the corresponding reservation number. If the withdrawal were posterior to the agreed date, the Customer will liquidate the pending days of payment, paying the amount at the daily prices in force on the date of the withdrawal of the Vehicle. In case of withdrawing the vehicle before the scheduled date, you are not entitled to any type of refund.

Article 5 - COMPLEMENTARY CONDITIONS AND PRICE

  1. The delivery of the Vehicle will depend on the procedure agreed between the customer and the company, that is, by direct delivery at Parking Santiago or by the procedure of collecting the vehicle at the airport (Valet/Driver Car) before boarding by a duly uniformed and identified collaborator, always taking into account the check-in procedures referred to in article 7.
  2. The reception of the Vehicle will depend on the prior request of the Customer, in one of the following modalities:
    1. Prior indication, (through reservations) by request made online on the website, at the time of delivering the Vehicle, or by telephone communication, or e-mail, indicating: flight/train, company, date and time of return of the customer, with an indication of the delivery modality of the same, which may be direct (delivery at the terminal, Valet/Driver Car) or free transport from the terminal to Parking Santiago.
    2. By communication to a duly identified collaborator of the Company present at the Airport or by telephone contact with the Company, notifying of the presence of the Customer and requesting the delivery of the Vehicle at the terminal or in the park with free transport. The Customer accepts that in that case the procedure for receiving the Vehicle may suffer delays or be denied.
  3. The price to be paid by the Customer will be that which appears in the price table displayed or, failing that, the price of the online simulator (www.parkingsantiago.es) (each fraction is 24 hours, partial periods or hours are not billed). Payment will be made online (pre-payment), or at the final act of delivery of the vehicle, taking into account the chosen procedure (Park/Valet) and the period used (always by POS, we do not accept cash.).

Article 6 - OBLIGATIONS OF THE CUSTOMER

The Customer undertakes to the Company to:

  1. Deliver the Vehicle in full mechanical condition, in full working order and with all technical revisions and inspections, as well as with all legally required documentation (under the framework of Spanish legislation), which adequately entitles the availability of the Vehicle by the Customer and its movement by employees of the Company in the terms of clause 4.1 b) and c) .
  2. Deliver the keys of the Vehicle (in any Park/Valet modality) that allow access to it or its mobility; the alarm remote if it is autonomous and also any other remote that allows deactivating the alarm in case of need.
  3. Allow access to the interior of the Vehicle and its driving by the Company's collaborators, in the terms and for the purposes of clause 4.2.
  4. Any other access to the Vehicle is excluded, with the exception of situations resulting from orders from entities with powers of authority, Police and judicial officials or with public order powers.
  5. Carry out the check-in and check-out procedures provided for in clause 7, subscribing to the corresponding documentation.
  6. Ensure to remove from your vehicle all belongings, goods that are not necessary to drive or park it (in particular all personal or valuable effects).
  7. Authorize the Company, through its collaborators, to remove from the Vehicle, after its delivery, any element incorporated into it, more easily detachable, such as an antenna and other accessories, which must be placed in the Vehicle at the time of its delivery.
  8. Pay the price of the services object of this contract in the terms of the price table in force at any time or, failing that, the price of the online simulator (www.parkingsantiago.es).
  9. Authorize the company to maneuver and park the vehicle in the Parking Santiago car parks and in facilities of other entities that have an agreement with Parking Santiago, within a 6 km radius.
  10. In the event of an accident, customers accept the repair of the vehicle in the workshop arranged by Parking Santiago to the detriment of any other.
  11. Customers whose vehicle is on public roads, in the event of an accident, must always activate the vehicle's mandatory insurance.

Article 7 - DELIVERY AND RECEPTION OF THE VEHICLE

  1. The delivery of the Vehicle, whether by immediate delivery at the Parking Santiago Parking, or delivery of it at the airport (Valet/Driver Car), will take into account the following points:
    1. The customer must deliver the Vehicle without any good that is not an integral part of it, whether in the passenger compartment, or in the trunk, specifically communication equipment, radios, computers, photographic cameras, clothes, glasses, money, etc. ... or any other physically removable good; of which Parking Santiago does not assume any responsibility.
    2. The Customer and the representative of the Company, must proceed to a check-in of the Vehicle, in which a registration of the interior and exterior of the same will be made, being able to proceed to photographic records, in order to register damages, wear or defects existing on the date of delivery. This registration will be kept for 3 days in the possession of the company after the vehicle is delivered.
    3. Also proceed, if the customer requests it, the subscription of the Company's reception document, in which the kilometers of the Vehicle, fuel level and other facts that may be relevant for the purposes of the Company's liability are declared.
  2. The reception of the Vehicle by the Customer either at the airport, or at the Parking Santiago parking, will be preceded by a check-out of the Vehicle, with a registration made by the Customer, in order to confirm if the Kilometers of the Vehicle, fuel level, etc. were requested..., as well as the absence of damage or any liability on the part of the Company. Any claim that the Customer intends to make must be made at the Company's facilities in the Parking. The responsibility of Parking Santiago expires at the moment the vehicle leaves our facilities or is delivered in conformity at the airport terminal.
  3. Taking into account the reception and Check-out to be carried out in the terms of the previous clause, any claim that the Customer may present regarding damages or deficiencies of the Vehicle must be sent within a maximum period of 3 working days after the date of reception of this, under penalty of expiration of the Customer's right to claim any damages.
  4. In the absence of a reservation or express claim by the customer at the time of return of the vehicle by the Parking Santiago valet at the airport or in the Parking Santiago parking, it will be considered that they acknowledge that their vehicle is in the same state as it was before they delivered it. No claim can be accepted in case of violation of these formalities and deadlines, by the customer.

Article 8 - RESPONSIBILITY OF THE COMPANY

  1. The Company will be responsible to the Customers for the damages that are culpably caused by its employees, strictly in the following cases:
    1. Damages caused to the Vehicle as a consequence of its handling within the Parking Santiago Parking and other facilities of other entities that have an agreement with Parking Santiago, within a 6 km radius, for the purposes provided for in clause 4.2.
    2. Any damage suffered by the Customer and their companions as a consequence of the transport, in the terms of clause 4.1c) d) provided that they are of an illicit act by way of gross negligence or malice on the part of the employees of the Company who perform the functions of driver of the transport Vehicle in question.
    3. Any other damages that occur from an illicit act with malice or gross negligence on the part of the employees and representatives or agents of the Company and whose responsibility cannot be excluded in the terms of clause 7.2.
  2. The responsibility of the Company is expressly excluded with respect to:
    1. Damages suffered by the Customer regarding theft of any good that has remained in the Vehicle after its delivery, as provided in clause 6.1f); 7.1 a).
    2. Any mechanical damage to the Vehicle that is not caused by employees of the Company, including damages caused by third parties as a result of their illegitimate intrusion into the Parking Santiago Parking, notwithstanding the perimeter closing, alarm and surveillance systems installed, or by disasters or natural causes beyond the Company's control.
    3. The insurance policy of Parking Santiago does not cover any damage resulting from natural disasters or adverse weather conditions.
    4. We are not responsible for isolated glass breakages.
    5. Recommendations for the delivery of the vehicle; airlines recommend 3 hours in advance for international flights and 2 hours for domestic flights. Although the reception of your vehicle and its transport to the terminal takes only a few minutes, the user of the car park must arrive at our facilities 20 minutes before the opening time of the check-in for their flight. We are not responsible for the loss of your flight. The company is not responsible for the loss of your flight if you do not comply with the check-in and if you do not arrive with sufficient advance notice or if the courtesy transport service is delayed, for example, due to excessive traffic, weather conditions, delays in entering the curbside because they are full, etc...
    6. The company will never be responsible for any problem your vehicle has when starting, due to mechanical failure, problems with the windows, flat or deflated tires, existing damage to the bodywork or lack of battery. We only commit to helping as much as possible, the customer cannot complain about these facts.
    7. Paint damage that is not caused by structural damage is excluded. Small scratches, chips and scuffs that affect the paint and/or parts of the vehicle that are not a consequence of structural damage to the vehicle (a blow and/or rubbing with a vehicle, column or other object, that deforms, dents and/or displaces one or more parts of the vehicle). Also excluded is damage to the underside of the vehicle and that which is not appreciable due to the dirtiness of the same.
    8. Parking Santiago is not responsible for payments made to intermediaries and their return and cancellation policies, and therefore declines any responsibility in this regard.
    9. Damage to luggage: The company is not responsible in any case for dents, scratches, stains, breakage of handles, locks and/or wheels that occur to luggage during handling and transfer to the airport and vice versa.

      The company will not be responsible for damage to perishable and fragile items transported in luggage.
  3. Parking Santiago reserves the right to move vehicles between the car parks and Facilities of other entities, which make their spaces available to it, for a better optimization of the parking space it has.

Article 9 - RESPONSIBILITY OF THE CUSTOMER

  1. The Customer will be responsible for any fines, sanctions, or liabilities that the Company has to pay by virtue of any irregularity verified in the Vehicle, in its documentation or in its ownership (within the framework of Spanish legality). Without prejudice to the rights of defense that assist the Company in the terms permitted by law, the Customer must reimburse the Company for all costs that it has incurred, including legal costs with lawyers and solicitors.
  2. In the event that the Customer does not pay the contracted price or any other expense borne by the Company, the latter has the right of retention over the Vehicle, which will be released as soon as the amount in debt is fully paid, which will include the price due by virtue of the increase in parking days of the Vehicle increased by default interest.
  3. The understanding of the general rules and conditions of the service in Spanish. Parking Santiago is not responsible for any damages or losses that may be caused to the customer or a third party due to a lack of understanding of the same.
  4. The customer agrees to the delivery/collection of their vehicle during the business hours of Parking Santiago (from 04:45 to 23:59 each day). If the collection/delivery is outside the business hours of Parking Santiago, the customer agrees to pay a surcharge in the price of €20

Article 10 - PROTECTION OF PERSONAL DATA

In accordance with Regulation (EU) 2016/679 and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, you are informed that your personal data will be incorporated into a data processing whose purpose is the management of the service contracted by the Company. The legitimacy is based on the consent of the Customer and for the execution of this Contract. Other bodies of the State Administration, the Autonomous Community of Madrid or the Municipality in which the facilities of Parking Santiago are located may be recipients. Customers may exercise the rights of access, rectification, deletion, opposition and limitation to the processing, by sending a written request to: info@parkingsantiago.es or at Lugar Noval nº 51 Lavacolla, 15820 Santiago De Compostela (A Coruña).

Article 11 - MISCELLANEOUS PROVISIONS

All communications between the parties that result in an alteration of this contract will be made in writing and addressed by the customer to the address, fax, e-mail of the Company and by the Company to the address of the Customer indicated in the particular conditions.

Article 12 - CONVENTION FORUM

The validity, interpretation and effects of this Contract/Service will be governed exclusively by Spanish laws. The Parties, expressly waiving their rights to submit to any other jurisdiction, submit to the courts and tribunals of the jurisdiction of Santiago de Compostela (Spain) for the resolution of any dispute, claim or controversy arising out of or in connection with this Contract, including any question regarding its existence, validity, resolution, nullity or effectiveness.

PRICE TABLE

  1. MINIMUM FRACTION: 24 HOURS, ONLINE PRICES ACCORDING TO RESERVATION (PARTIAL PERIODS OR HOURS ARE NOT BILLED).
  2. TRANSPORT/COLLECTION OF PASSENGERS TO THE AIRPORT: FREE
  3. COLLECTION/DELIVERY FEE AT THE AIRPORT (VALET/DRIVER CAR): INCLUDED IN THE PRICE ALL PERIODS ARE 24 HOURS, EXCEPT THE LAST DAY WHICH HAS A 4-HOUR TOLERANCE FOR POSSIBLE DELAYS.
  4. ALL PRICES INCLUDE V.A.T. AND CURRENT TAXES.
  5. THE PRICES ARE THOSE PRACTICED ONLINE FOR EACH MOMENT OF CONTRACTING.
  6. IN CASE THE CUSTOMER HAS TO WITHDRAW THEIR VEHICLE OUTSIDE THE PARKING'S OPENING HOURS, THIS SERVICE WILL HAVE A SURCHARGE OF €20 PER STAY.
